Starting October 12, 2025, employers in Romania are required to grant additional telework days to specific categories of employee-parents, according to the amendments brought to the Labour Code by Law no. 149/2025.

Who benefits from the new provisions?

Parents caring for children with disabilities

These employees are entitled to twice as many telework days per month compared to other parents. Specifically:

  • 8 days/month of telework or work from home for the care of a child with disability;
  • In the case of employees who have two or more dependent children with disabilities, each additional child entitles the parent to two extra days/month of telework or work from home (up to the age of 18).

Parent of twins, triplets or multiples

These parents also benefit from an extended telework regime:

  • 8 days/month of telework;
  • +2 additional days/month for each child in the group.

Parents of children of up to 11 years old

According to the previous regulations still in force, parents of children under the age of 11 are entitled to 4 days of telework/month, in order to care for their children.

Conditions and Limitations

  • This right cannot be refused by the employer except when the nature of the job does not allow for telework or work from home — for instance, in roles that require constant physical presence (e.g., manufacturing, transport, hands-on services).
  • For parents of children with disabilities, the request must be accompanied by the official disability certificate of the child.
  • Important: Even if only a few telework days per month are requested, it is still mandatory to sign an addendum to the individual employment contract. This addendum must include all the elements required by the Telework Law (Law no. 81/2018).
