According to GEO 117/2022, the duration of paternity leave is ten working days, to which five additional days are granted for employees who follow a childcare course. According to the above ordinance, the father may benefit from paternity leave for each newborn child, based on the certificate of graduation of the childcare course, regardless of when it is obtained.

Paternity leave is approved based on the application, accompanied by the child’s birth certificate, and is granted in the first eight weeks from the child’s birth.

The employer is obliged to approve paternity leave and inform the employees about the right established under this law.

The allowance for paternity leave is paid by the employer and is equal to the salary corresponding to the respective period. The period of paternity leave constitutes seniority in service.

The employer may not dispose of the employment contract in the case of a worker who is on paternity leave. It is also forbidden to apply less favorable treatment to the father who used for or took paternity leave.

The worker’s rights before the paternity leave shall be maintained for the duration of this leave and shall apply after its termination.

Failure to comply with the above provisions is a contravention and is sanctioned with a fine from 4,000 lei to 8,000 lei.

This emergency ordinance applies from August 29, 2022.
