Authorities have introduced significant amendments to Law No. 448/2006 on the protection and promotion of the rights of persons with disabilities.
Main Legislative Changes
- Obligation to Employ Persons with Disabilities
- Under the new regulations, employers with at least 50 employees are required to ensure that at least 4% of their total workforce consists of persons with disabilities.
- If this obligation is not met, employers must contribute to the state budget with an amount equivalent to the national gross minimum wage multiplied by the number of job positions not occupied by persons with disabilities.
- Employer Reporting Obligations
- Starting this year, employers with at least 50 employees must submit an annual report by January 31, providing a centralized overview of positions occupied by employees with disabilities and an inventory of the competencies required for employment.
- The first report, covering the year 2024, must be submitted by January 31, 2025, and the official template for this report has been recently published through Order No. 28/11/2025.
- Reports must be submitted to the National Authority for the Protection of the Rights of Persons with Disabilities (ANDPD) and the National Employment Agency (ANOFM) via regional employment agencies.
- Even if an employer does not have any employees with disabilities, the reporting obligation still applies.
- Employers are also required to notify at least three non-governmental organizations (NGOs)—which provide specialized services for persons with disabilities and are registered in the National NGO Registry—about job vacancies.
- Additionally, employers must send proof of job vacancy notifications to ANDPD and AJOFM.
Failure to comply with these reporting obligations may result in penalties ranging from 25,000 RON to 50,000 RON.
